Spanish court rules linking to pirate sites is not illegal
Tuesday, Mar 16th 2010 at 8:24AMThe ruling came as part of Spanish copyright society SGAE's action against the ElRincondeJesus.com site which linked to eDonkey.
Judge Raul N. Garcia Orejudo ruled that offering links to infringing content is not the same as actually making that content available.
He added that in ElRincondeJesus.com's case it was not generating profits from access to this content and so could not be classed as a business benefitting financially from infringement of others' copyrighted works.
