The case was <a href="http://www.musicweek.com/story.asp?sectioncode=1&storycode=1049555">taken to the European Court in May</a> with Neij's lawyer Jonas Nilsson arguing that the function of The Pirate Bay is protected by the Convention for the Protection of Human Rights.
Specifically, Article 10 of the European Convention guarentees citizens of Sweden the freedom to receive and impart information.
